Do I need a Solicitor to buy or sell a property in Scotland?

Yes. A Solicitor is responsible for the legal work involved in buying or selling a property. This includes examining the title, dealing with the missives, carrying out the necessary searches and investigations, liaising with your lender where applicable, and completing the transaction at settlement.

At Middleton Ross, we can guide you through the process from your initial offer or decision to sell through to completion.

What is a Home Report?

A Home Report is a package of information which is generally required when a residential property is marketed for sale in Scotland.

It normally includes:

  • a Single Survey and valuation;
  • a Property Questionnaire completed by the seller; and
  • an Energy Report.

The Home Report provides prospective purchasers with important information about the property before they make an offer.

It is important to remember that the Home Report is separate from the legal title investigations carried out by your Solicitor as part of the conveyancing process.

When should I instruct Middleton Ross?

As early as possible.

If you are selling, instructing us before or when your property goes on the market means that we can start preparing the legal side of the transaction and identify any potential title issues early.

If you are buying, it is sensible to have a solicitor instructed before you make an offer so that you are ready to proceed when the right property comes along.

At Middleton Ross, we can handle the legal work whether you are buying, selling or doing both at the same time, and our estate agency team can also assist if you are selling your property through Middleton Ross.
