Do I need a Solicitor to buy a new build property in Scotland?

Yes. A Solicitor is responsible for the legal work involved in buying buying the  property. This includes examining the title, dealing with the missives, carrying out the necessary searches and investigations, liaising with your lender where applicable, and completing the transaction at settlement.

At Middleton Ross, we can guide you through the process from your initial offer through to collecting your keys.

When should I instruct Middleton Ross?

As early as possible.

If you are selling, instructing us before or when your property goes on the market means that we can start preparing the legal side of the transaction and identify any potential title issues early.

If you are buying, it is sensible to have a solicitor instructed before you make an offer so that you are ready to proceed when the right property comes along.

At Middleton Ross, we can handle the legal work whether you are buying, selling or doing both at the same time, and our estate agency team can also assist if you are selling your property through Middleton Ross.

What are missives?

The missives are the formal letters exchanged between the buyer’s and seller’s solicitors which form the contract for the purchase of the property. The developer's solicitors issue an Offer to Sell to the purchasing solicitors, which are negotiated and/or accepted to form the missives.

The missives deal with matters such as the purchase price, date of entry and any additional conditions relating to the transaction.

Once the missives are concluded, the contract is legally binding.

What is LBTT

Land and Buildings Transaction Tax (LBTT) is a tax that may be payable when you purchase residential or commercial property or land in Scotland.

The amount payable depends on factors including the purchase price and your circumstances. Different rates and reliefs can apply in certain circumstances, including for first-time buyers and purchasers of additional properties.

Your Solicitor will calculate the LBTT due on your purchase and can deal with the relevant return and payment on your behalf.

What happens on the day of settlement?

Settlement is the point at which the purchase or sale is completed. It is often referred to as the Date of Entry, or the Completion Date.

Your Solicitor will arrange payment of the purchase price to the seller’s solicitor in exchange for the documents required to transfer ownership of the property.

Once settlement has taken place, you will normally meet with a site manager to collect the keys and take possession of your new property.

Can I sell and buy at the same time?

Yes. In fact, many people sell their existing property and purchase a new one as part of the same move.

Your Solicitor can deal with both transactions and coordinate the two so that, where possible, your sale and purchase settle on the same day.

This can involve additional coordination, particularly where there is a chain of transactions, but we can guide you through the process and keep you informed of progress.

When should I instruct Middleton Ross?

As early as possible.

It is sensible to have a solicitor instructed before you make an offer so that you are ready to proceed when the right property comes along.
