Buying and Selling at the Same Time

We can provide an estimate of the legal expenses, answer any queries you may have and help you take the next steps to getting the keys to your new build purchase.

Do I need a Solicitor to sell a property in Scotland?

Yes. A Solicitor is responsible for the legal work involved in selling a property. This includes examining the title, dealing with the missives, carrying out the necessary searches and investigations, repaying the mortgage to your lender where applicable, and completing the transaction at settlement.

At Middleton Ross, we can guide you through the process from your initial offer or decision to sell through to completion.

Can I sell and buy at the same time?

Yes. In fact, many people sell their existing property and purchase a new one as part of the same move.

Your Solicitor can deal with both transactions and coordinate the two so that, where possible, your sale and purchase settle on the same day.

This can involve additional coordination, particularly where there is a chain of transactions, but we can guide you through the process and keep you informed of progress.

What are missives?

The missives are the formal letters exchanged between the buyer’s and seller’s solicitors which form the contract for the sale of the property.

They deal with matters such as the purchase price, date of entry and any additional conditions relating to the transaction.

Once the missives are concluded, the contract is legally binding.

When are searches carried out?

As part of the conveyancing process, your Solicitor will carry out appropriate searches and investigations relating to the property.

These can include searches of the Land Register and relevant local authority information, as well as examination of the title deeds and other matters affecting the property.

The investigations help identify matters such as title restrictions, rights affecting the property, planning or building issues and other information which may be relevant to the property.

The precise searches and investigations required will depend on the property and circumstances of the transaction.

What happens if there is a problem with the title?

If we identify an issue with the property’s title, we will explain the problem to you and advise you on the options available.

Some title issues are relatively straightforward to resolve. Others may require additional documentation, enquiries or negotiations with the seller’s solicitor.

One of the key purposes of using a Solicitor is to identify potential problems in advance, to make the transaction as straightforward as possible.

What happens on the day of settlement?

Settlement is the point at which the purchase or sale is completed. It is often referred to as the Date of Entry, or the Completion Date.

Your Solicitor will receive the purchase money, repay any mortgage secured over the property and account to you for the balance, after deduction of any relevant costs.

When should I instruct Middleton Ross?

As early as possible.

If you are selling, instructing us before or when your property goes on the market means that we can start preparing the legal side of the transaction and identify any potential title issues early.

If you are buying, it is sensible to have a solicitor instructed before you make an offer so that you are ready to proceed when the right property comes along.

At Middleton Ross, we can handle the legal work whether you are buying, selling or doing both at the same time, and our estate agency team can also assist if you are selling your property through Middleton Ross.
