Auction Property Conveyancing

Buying Property at Auction

Auction purchases move quickly. They often involve tight deadlines and you can quickly commit yourself to a purchase without knowing the full scope of what you are buying.

Our legal team can review auction legal packs and provide advice before and after a successful bid. We always recommend contacting us before a bid is submitted, because there is often little scope for negotiation once your bid is successful.

Before You Bid

We can provide the following service:

  • Examine title documents
  • Review conditions of sale
  • Advise you of potential risks
  • Provide practical advice on any anticipated legal issues

After a Successful Bid

A legally binding contract is usually formed shortly after the end of the auction. At that stage, we can provide the following service:

  • Complete the conveyancing process
  • Liaise with a mortgage lender, where finance is required
  • Arrange settlement within strict deadlines
  • Register your ownership

Do I need a Solicitor to buy a property in Scotland?

Yes. A Solicitor is responsible for the legal work involved in completing the purchase of a property, even through an auction process. This includes examining the title, carrying out the necessary searches and investigations, liaising with your lender where applicable, and completing the transaction at settlement.

At Middleton Ross, we can guide you through the process from your initial offer or decision to sell through to completion.

What is LBTT?

Land and Buildings Transaction Tax (LBTT) is a tax that may be payable when you purchase residential or commercial property or land in Scotland.

The amount payable depends on factors including the purchase price and your circumstances. Different rates and reliefs can apply in certain circumstances, including for first-time buyers and purchasers of additional properties.

Your Solicitor will calculate the LBTT due on your purchase and can deal with the relevant return and payment on your behalf.

When should I instruct Middleton Ross?

As early as possible.

If you are selling, instructing us before or when your property goes on the market means that we can start preparing the legal side of the transaction and identify any potential title issues early.

If you are buying, it is sensible to have a solicitor instructed before you make an offer so that you are ready to proceed when the right property comes along.

At Middleton Ross, we can handle the legal work whether you are buying, selling or doing both at the same time, and our estate agency team can also assist if you are selling your property through Middleton Ross.
